The Gene Stipe Dance
Yesterday and today have been fascinating for “Stipe Watchers”.
Yesterday’s news was that U.S. Judge Ronald White issued a written denial after Gene Stipe’s attorneys requested on Tuesday that he be allowed to stay in the state.
This morning the 10th U.S. Circuit Court of Appeals granted Stipe a “stay” of that order, therefore letting Stipe stay in Oklahoma. This rather than turning himself in to the U.S. Medical Center for Federal Prisoners in Springfield, Missouri for a mental and physical evaluation as has been ordered.
Stipe was originally ordered to report to the federal facility by noon today. He did not make it thanks to the stay from the Appeals Court.
Hopefully Gene Stipe didn’t get his suitcases completely unpacked though, for by late afternoon the 10th U.S. Circuit Court of Appeals reversed the order it issued earlier in the day staying Judge White’s order requiring Stipe to report to the federal hospital for mental competency testing.
In dissolving its earlier order the Appeals Court said Stipe must report to the federal prison hospital in Springfield by noon on Monday.
Of course that gives Stipe’s attorney Clark Brewster an entire weekend to put together an appeal to the U.S. Supreme Court, fax it to Washington, D.C. and go for a “Hail Marry” in his efforts at keeping Gene Stipe out of the hands of the feds for as long as possible.
There’s an old saying about “Being careful of what you wish for. You just might get it”. It is a saying evidently lost on Clark Brewster for it is he who asked for a physical and mental evaluation for his client, possibly in an attempt to delay a federal hearing on whether Stipe’s probation will be revoked.
Slowly but surely the feds are closing in, cutting off first one and then another avenue of delay. Brewster for his part is stalling for all he’s worth trying to keep Gene Stipe in Oklahoma for every second possible.
And who can blame him, as Brewster is likely being well payed to do so.
Somewhere during all this back and forth Gene Stipe probably just keeps packing and unpacking his bags, while waiting for one of the two inevitable options, prison or death.
Knowing of the history of Gene Stipe and the stalling tactics of Clark Brewster, odds are death may take Gene Stipe before the feds but we will just have to wait and see.
And to those of us watching from the cheap seats it is fascinating entertainment…
