HB 1804 Law Suit Redux

Reverend Victor Orta, the National Coalition of Latino Clergy and illegal immigration apologists late last week managed to raise from the dead their lawsuit challenging House Bill 1804, a state law aimed at illegal immigrants.

They managed to breath life back into the effort by bringing forth additional plaintiffs who say they are facing eviction because of the impending measure.

Using the “victimization” excuse, those seeking to circumvent the will of the people of Oklahoma are hoping to sidetrack at least for the time being implementation of HB 1804.

Previously a federal judge in Tulsa had tossed their lawsuit on the basis that none of the plaintiffs in the suit could demonstrate that they were harmed by HB 1804. In this redux effort, Orta and cronies are hoping to convince a federal judge to grant an injunction against HB 1804 on the basis that two apparent illegal aliens will be evicted from property they are evidently renting while being in this country illegally.

When U.S. District Judge James H. Payne dismissed the first lawsuit he did so because the original suit’s plaintiffs, the National Coalition of Latino Clergy, its Oklahoma affiliate, two churches, a restaurant group and several anonymous individuals could not show that it had damaged them. Now we have the same group plus a couple of illegal aliens trying a “Hail Mary” saying that they have been “threatened with eviction” when HB 1804 goes into effect.

A key word of Judge Payne’s ruling is the word “had” in regard to damaging the plaintiffs. The judge tossed the first lawsuit because the plaintiffs could not show HB 1804 *HAD* damaged them.

Hopefully Judge Payne uses the same logic in tossing the second lawsuit on Halloween, when he is set to rule on the matter. HB 1804 will not have gone into effect at that time. Therefore it is impossible for HB 1804 to have damaged anyone, as it would not be law at the time. It goes into effect 24 hours later.

Undoubtedly there is going to be enormous pressure on Judge Payne to side with the illegal alien apologists. Hopefully he will stick with the U.S. Constitution and the rule of law and in the process give this second law suit the same heave-ho he gave the first.

It is the right thing to do in spite of what Reverend Orta and his cronies may say…
