No Bull In Midwest City

Harley and Diesel, a couple of bull terriers that live in Midwest City, Oklahoma with their people Carol and Jerry Stuckey, may be feeling a bit paranoid right about now and justifiably so.

It seems that city officials say they’re authorized to seize the Stuckey’s dogs, not because of anything the dogs have done but rather simply because of what they are, bull terriers.

Back in 1987 Midwest City enacted an ordinance that bans several types of terriers; bull terriers, Staffordshire bull terriers, American pit bull terriers and American Staffordshire terriers.

And this in spite of state law that specifically prohibits enacting breed-specific dog bans.

Katherine Bolles, city attorney for Midwest City, says that Midwest City is a “home-rule charter city” which allows it to pass ordinances that may not be in accordance with state law. This in spite of an opinion issued by the attorney general’s office which ruled that Oklahoma law “permits local authorities to regulate potentially dangerous or dangerous dogs, provided the regulations are not breed specific.”

Evidently the folks running the show in Midwest City consider themselves so above the law that they can ignore any law they wish and can make up any law that strikes their fancy.

Until Midwest City is brought under the rule of law, Harley and Diesel might want to keep a low profile as Bolles says that the city, while it can not enter the Stuckey home or yard to seize the dogs, is looking to loop scoop them the first opportunity that presents itself.

Sounds like what is needed are some city officials in Midwest City, Oklahoma that understand they are not above the law.

Until then Harley and Diesel are going to be in danger of being kidnapped and possibly put to death for what they are rather than anything they have done and that is just not right.

  1. I work with these dogs and as far as animal behavior goes, I’m a firm believer in nurture and exercising. I’ve met Jack Russell Terriers that I wouldn’t go in close proximity to again, but have certainly not had a bad encounter with an American Staffordshire Terrier. If you are speaking about their owners- well, that’s a different story. People are animals as nicely, and we have a tendency to every have our individual ideas about “moral concepts”.
